Creator Terms

These Creator Terms govern your participation in the NoirDeck Creator Programme once your application has been approved. By submitting an application, and again upon approval, you agree to be bound by these terms in addition to our general Terms of Service.

You must be at least 18 years old and able to enter into a binding agreement to apply as a creator.

Applications are reviewed at our discretion. We assess factors including the quality and suitability of your proposed content, your public profile, and alignment with NoirDeck's premium, non-explicit brand standards.

We are not obliged to approve any application, and we may decline an application without providing a detailed reason. You may re-apply after a reasonable period if your application is not approved.

We may revoke creator status at any time for breach of these terms or our content standards (see Section 6).

When you submit source images for card generation, you grant NoirDeck a non-exclusive, worldwide, royalty-free licence to: (a) process those images using our AI stylisation pipeline to produce derivative trading card artwork; (b) reproduce, display, and distribute the resulting cards on the platform and in promotional materials for the platform; and (c) retain copies for moderation, technical, and archival purposes.

You retain ownership of your original source images. NoirDeck owns the platform, the card templates, the AI-generated stylised artwork derived from your images, and the associated metadata (rarity, edition, serial number) as platform content, subject to your underlying rights in your likeness and original images.

This licence continues for as long as your cards remain live on the platform, and survives removal solely to the extent needed for records, dispute resolution, and legal compliance.

By submitting images and applying as a creator, you confirm that:

• You own or hold all necessary rights, consents, and permissions in the images you submit, including your own likeness · The images do not infringe any third party's intellectual property, privacy, or other rights · The images and any associated description are accurate, lawful, and not misleading · You will not submit content that is explicit, depicts minors, or otherwise breaches our Content Standards

You agree to indemnify NoirDeck against any claim, loss, or expense arising from a breach of these warranties.

Creator earnings are paid via Stripe Connect Express. You will need to complete Stripe's identity verification (KYC) before any payout can be made — this is a legal requirement and is handled directly by Stripe, not NoirDeck.

Where applicable, NoirDeck pays creators a share of platform revenue generated from packs and marketplace activity featuring their cards, calculated and disclosed at the rate communicated to you at the time of approval. Marketplace resales carry a 10% platform fee, deducted before any creator share is calculated.

You are solely responsible for declaring and paying any tax on your earnings in your jurisdiction. NoirDeck does not provide tax or financial advice.

Payouts may be delayed, withheld, or reversed where we reasonably suspect fraud, manipulation, or breach of these terms, pending investigation.

All creator content must be lawful, non-explicit, and consistent with NoirDeck's premium brand. The following is strictly prohibited and will result in immediate removal and likely termination of creator status:

• Explicit sexual content or nudity · Any depiction or implication involving minors · Hateful, violent, or discriminatory material · Content that infringes a third party's rights · Misleading, fraudulent, or impersonatory content

We use a combination of automated moderation and human review before any card is published. We may decline to publish, or remove, any submission that does not meet our standards — entirely at our discretion — without it constituting a breach of these terms on our part.

NoirDeck uses a fixed set of curated style presets to transform approved source images into stylised trading card artwork. Creators select from these presets; NoirDeck does not accept open-ended or user-defined generation prompts.

We may update, retire, or add style presets over time. Cards already generated are not retroactively altered when presets change.

The licence you grant us under Section 3 is non-exclusive — you remain free to license or sell your images and likeness elsewhere, subject to any separate agreement we may enter into with you that states otherwise.

You may not represent that NoirDeck endorses, sponsors, or is affiliated with any third-party product or platform unless we have agreed to this in writing.

We may suspend or revoke your creator status at any time for breach of these terms, our Content Standards, or our general Terms of Service. Where the breach is not severe, we will generally provide notice and an opportunity to respond first.

You may withdraw from the Creator Programme at any time by contacting us. Cards already issued to collectors remain in their collections; we do not retroactively remove cards from existing holders upon a creator's withdrawal, save where required by law (for example, a valid takedown notice).

Sections 3 (Licence), 4 (Warranties), 5 (Earnings — for amounts already accrued), and 11 (Liability) survive termination.

We may update these Creator Terms from time to time to reflect changes to the programme, the law, or our processes. Where changes are material, we will notify approved creators by email at least 14 days before they take effect. Continuing to participate in the programme after that date constitutes acceptance of the updated terms.

To the fullest extent permitted by law, NoirDeck's total liability to you in connection with the Creator Programme shall not exceed the total amount paid to you under the programme in the 12 months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

These Creator Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
